Article 1. Purpose

These Terms and Conditions of Sale are intended to define the contractual relationship between LUTECE COSMETICS and the buyer, as well as the conditions applicable to any purchase made through the lutececosmetics.com website. The purchase of a product through this website implies the buyer’s unconditional acceptance of these Terms and Conditions of Sale, which the buyer acknowledges having read prior to placing an order. Prior to any transaction, the buyer declares, on the one hand, that the purchase of products on the lutececosmetics.com website is not directly related to their professional activity and is limited to strictly personal use, and, on the other hand, that they have full legal capacity, enabling them to enter into a binding agreement under these General Terms and Conditions of Sale.

LUTECE COSMETICS reserves the right to modify these terms and conditions of sale at any time in order to comply with any new regulations or to improve the user experience on its website. Consequently, the applicable terms and conditions will be those in effect on the date the buyer places the order.

Article 2. Products

The products offered are those listed on the website https://www.lutececosmetics.com operated by LUTECE COSMETICS, subject to availability. LUTECE COSMETICS reserves the right to modify its product lineup at any time. Each product is presented on the website with a description detailing its main technical characteristics. The photographs are as accurate as possible but are not binding on the Seller. The sale of products presented on the website https://www.lutececosmetics.com is intended for all buyers residing in countries that fully authorize the import of these products into their territory.

Article 3. Rates

The prices listed on the product pages of the online catalog are in euros (€) and include all taxes (TTC), reflecting the applicable VAT rate on the date of the order. Any change in the VAT rate may be reflected in the price of the products. LUTECE COSMETICS reserves the right to modify its prices at any time; however, the price listed in the catalog on the date of the order will be the only price applicable to the buyer. The prices listed do not include shipping costs, which are billed in addition to the price of the purchased products based on the total order amount.

Please note that customs fees may apply for shipments to certain regions. These fees are the customer's responsibility and are not included in the order price.

Article 4. Ordering and Payment Terms

Before placing an order, the buyer must create an account on the webhttps://www.lutececosmetics.com. The account creation section is accessible directly from the side menu bar. Each time they visit the site, buyers who wish to place an order or view their account (order status, profile, etc.) must log in using this information. LUTECE COSMETICS offers buyers the option to order and pay for their products in several steps, with a choice of 3 payment options:

– Secure credit card payment: The buyer selects the products they wish to order and adds them to the “shopping cart,” makes any necessary changes (quantities, product codes, etc.), and verifies the shipping address or enters a new one. Next, the shipping costs are calculated and displayed to the buyer, along with the name of the carrier. Next, the buyer selects their preferred payment method: “Credit Card Payment.” Finally, the last step prompts the buyer to review all the information, read and accept these Terms and Conditions of Sale by checking the corresponding box, and then confirms the order by clicking the “Confirm My Order” button. This final click constitutes the definitive conclusion of the contract. Upon confirmation, the buyer receives an order confirmation confirming that the order has been placed.

– Secure payment via PayPal or credit card (through the PayPal system): The buyer selects the products they wish to order and adds them to the “shopping cart,” makes any necessary changes (quantities, product codes, etc.), and verifies the shipping address or enters a new one. Shipping costs are then calculated and displayed to the buyer, along with the name of the carrier. Next, the buyer selects their preferred payment method: “Pay via PayPal.” The following step prompts the buyer to review all the information, read and accept these Terms and Conditions of Sale by checking the corresponding box, and then confirms the order by clicking the “Confirm My Order” button. Finally, the buyer is redirected to the secure PayPal interface to safely enter their PayPal account or personal credit card information. If the payment is accepted, the order is registered and the contract is definitively formed. Payment via PayPal or credit card is irrevocable. In the event of fraudulent use, the buyer may request cancellation of the credit card payment; the amounts paid will then be credited back or refunded. The credit cardholder is not liable if it is proven that the disputed payment was made fraudulently, remotely, without physical use of the card. To obtain a refund for the fraudulent charge and any bank fees the transaction may have incurred, the cardholder must dispute the charge in writing with their bank within 70 days of the transaction, or within 120 days if their contract with the bank so provides. The bank must refund the debited amounts within one month of receiving the cardholder’s written dispute. The cardholder may not be charged any fees for the refund.

Confirmation of an order constitutes acceptance of these terms and conditions of sale, acknowledgment that the buyer is fully aware of them, and a waiver of the right to rely on the buyer’s own terms and conditions of purchase. All data provided and the recorded confirmation shall serve as proof of the transaction. If the buyer has an email address and has entered it on the order form, LUTECE COSMETICS will send confirmation of the order’s registration via email.

Article 5. Retention of Title

LUTECE COSMETICS retains full and complete ownership of the products sold until full payment has been received, including the principal amount, fees, and taxes.

Article 6. Right of Withdrawal

Pursuant to Article L121-20 of the Consumer Code, the buyer has fourteen business days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for an exchange or refund without penalty, except for return shipping costs. 

Products must be returned new and unopened.

Items on sale are neither refundable nor exchangeable.

Any product returned incomplete, damaged, used, washed, soiled, or consumed—even partially—will not be refunded.

Return Policy for Intimate and Body Care Products

For hygiene and safety reasons, intimate and body care products (such as creams, lotions, gels, sprays, oils, and other cosmetics) that have been opened or unsealed after delivery cannot be returned, exchanged, or refunded. This policy complies with Article L221-28 of the French Consumer Code, which provides an exception to the right of withdrawal for products that cannot be returned for health or hygiene reasons once they have been unsealed.

Deliveries are made to the address indicated on the order form, which must be within the agreed-upon geographic area. Orders are shipped by La Poste via COLISSIMO, a tracked delivery service that requires no signature upon delivery. Delivery times are provided for informational purposes only; if they exceed thirty days from the date of the order, the sales contract may be terminated and the buyer reimbursed. LUTECE COSMETICS may provide the buyer with the tracking number for their package via email. The buyer’s order is delivered to their home by their mail carrier. If the buyer is not home, they will receive a delivery notice from the mail carrier, allowing them to pick up the ordered products at the nearest post office within the timeframe specified by the postal service. The buyer assumes all risks associated with shipping from the moment the items leave the premises of Lutece Cosmetics. The buyer is required to inspect the condition of the packaging and the contents of the shipment upon delivery in the presence of the postal worker or delivery person. In the event of damage during transit, any claim must be filed with the carrier within three days of delivery.

Article 8. Warranty

All products supplied by LUTECE COSMETICS are covered by the legal warranty provided for in Articles 1641 et seq. of the Civil Code. In the event that a product sold does not conform to its description, it may be returned to LUTECE COSMETICS, which will accept the return, exchange the product, or issue a refund. All complaints, requests for exchanges, or refund requests must be submitted by mail.

Article 9. Liability

In the context of distance selling, LUTECE COSMETICS is bound only by an obligation of means. The company shall not be held liable for any damage resulting from the use of the Internet, such as data loss, unauthorized access, viruses, service interruptions, or other unforeseen issues.
